Insurance Requirements

Upon award of a contract, Service Providers/Contractors may be asked to submit a Certificate of Insurance (COI) that meets or exceeds the following requirements: 

  • All policies shall evidence insurance written by a carrier licensed in the State of Texas and should be rated an “A-“ or better in AM Best Key Rating Guide. 
  • Proof of Insurance must be supplied in advance and allow time to process request. No vendor or contractor should begin working without supplying proper insurance requirements. 
  • All vendors and contractors who cancel or make changes to their insurance coverage shall provide Comal ISD a 30 day notice of cancellation or non-renewal coverage. 
  • Renewal certificates of insurance shall be provided annually until all work in completed. 
  •  Comal ISD is to be name as “Additional Insured and such insurance shall be primary and non-contributory” on the certificate of Insurance. 
  •  A Waiver of Subrogation shall be issued in favor of Comal ISD with respects to General Liability and Workers Compensation Insurance. 
  • If the product or service represents an unusual or exceptional risk, additional insurance for that product or service may be required. 
  • All requirements apply to contractors and sub-contractors at all tiers. 

  

The following minimum insurance standards shall apply to all vendors performing, selling, or distributing products and services at Comal ISD. 

Level 1 Risk: 

Vendors/contractors coming on site during school hours performing services not related to student or with no direct contact with students. Example: Instructor comes in to perform professional development for teachers. 

Requirements: 

  • $1,000,000 PER OCCURANCE/$2,000,000 GENERAL AGGREGATE – COMMERCIAL GENERAL LIABILITY INSURANCE 
  • PROOF OF WORKERS’ COMPENSATION COVERAGE for all contractors performing work. 

 

Vendors/contractors coming on site after hours to perform services not related to student or with no direct contact with students. Example: Vendor is hired to change air filters while students are not in school or supervised by a Comal ISD employee. 

Requirements: 

  • $1,000,000 PER OCCURANCE/$2,000,000 GENERAL AGGREGATE – COMMERCIAL GENERAL LIABILITY INSURANCE 
  • PROOF OF WORKERS’ COMPENSATION COVERAGE for all contractors performing work. 

 

Level 2 Risk: 

Vendors/Contractors having direct contact with students during school hours. Example: Petting Zoo, Bounce Houses, etc. 

Requirements: 

  • $1,000,000 PER OCCURANCE/$2,000,000 GENERAL AGGREGATE – COMMERCIAL GENERAL LIABILITY INSURANCE 
  • PROOF OF WORKERS’ COMPENSATION COVERAGE for all contractors performing work. 
  • Additional requirements may apply. 

 

Level 3 Risk: 

Vendor/contractors having direct contact with students after school hours. Example: After school program for CISD Students, No CISD Staff supervising activities.

Requirements: 

  • $1,000,000 PER OCCURANCE/$2,000,000 GENERAL AGGREGATE – COMMERCIAL GENERAL LIABILITY INSURANCE 
  • $1,000,000 PROFESSIONAL LIABILITY/ E&O POLICY (as applicable) 
  • Additional requirements may apply. 

  

New Construction Contractor COI Requirements: 

  • General Aggregate Limit: Must be Project/Location only = $2,000,000 
  • Workers’ Compensation: Project/Location only = Statutory Limits 
  • Verify Surety Bonds with Secretary of State/Contact Surety Bond Underwriter 
  • Verify coverage again within 30 days from the date work is set to begin 
 
 

Food Truck Vendors:

An Independent Contractor Agreement must be approved, fully executed, and on file with the Comal ISD Purchasing Department before any Food Truck is allowed on Comal ISD property.

  • $1,000,000 PER OCCURANCE/$2,000,000 GENERAL AGGREGATE – COMMERCIAL GENERAL LIABILITY INSURANCE
  • PROOF OF WORKERS’ COMPENSATION COVERAGE for all contractors performing work.
  • Copy of the valid permit sticker that is required to be displayed on the mobile food unit.

All suppliers providing food through a Comal ISD contract must have a Foodborne Illness Emergency Plan. Food Borne Illnesses are caused by a variety of foodborne pathogenic bacteria, viruses, prions, or parasites that contaminate food. Suppliers will have a Foodborne Illness Emergency Plan available for inspection that provides guidance for emergency response operations in compliance with all County, State and Federal regulations.
