Dear Comal ISD Community,
This article is to be sure you are aware that Comal ISD is being sued for standing up for student, staff and environmental safety by opposing a new natural gas pipeline to be built through an existing easement on Davenport High School property.
In late 2025, the District was contacted by Howard Energy Partners, majority owned by a Canadian investment firm, Alberta Investment Management Corporation, regarding the Outer Loop Pipeline Project, an approximately 63-mile intrastate natural gas pipeline project spanning Bexar, Comal, and Guadalupe counties. The District raised concerns regarding the safety and environmental impacts associated with a natural gas pipeline being laid on, rather than routing around, school property.
Now, Howard Energy Partners, through its affiliated entity Outer Loop Utility, LLC, has filed condemnation proceedings seeking to acquire the easement through eminent domain. The District opposes this action, and the Board of Trustees will continue that opposition from its June 25, 2026, meeting.
The pending litigation is Outer Loop Utility, LLC v. Comal Independent School District, Case No. 2026CV0262, filed in Comal County Court at Law No. 3.
Because this is an active legal matter, Comal ISD is unable to comment further on the specifics of the litigation. The District's priority throughout this process remains the safety of students and staff and the integrity of the Davenport High School campus.
