Section 504 of the Rehabilitation Act is a civil rights legislation that protects individuals with disabilities from discrimination. The act predated and laid the groundwork for the current Individuals with Disabilities Education Improvement Act (IDEIA), an entitlement program with funding for students meeting specific disability guidelines. Section 504, as civil rights legislation, prevents discrimination against students based on their disability, but does not provide funding to develop new programs for qualified students.
Section 504 of the Rehabilitation Act of 1973:
“No otherwise qualified individual with disabilities
in the United States . . . shall, solely by reason of his
disability, be excluded from the participation in, be
denied benefits of, or be subjected to discrimination
under any program or activity receiving
federal financial assistance. . .”
Comal ISD has policies and procedures in place to address the needs of students with disabilities under Section 504. Referrals go through the campus GIST (General Intervention Support Team) Committee. When classroom intervention options to assist a child to be successful have been tried and a disability is suspected, the GIST Committee may refer the student for Section 504 evaluation.
